Starting or operating an industrial unit in Haryana requires environmental clearance from the Haryana State Pollution Control Board (HSPCB). The two primary approvals required are Consent to Establish (CTE) and Consent to Operate (CTO) under the provisions of the Water Act, 1974 and the Air Act, 1981. These consents ensure that industries comply with environmental norms and pollution control standards before and during operations.

What is Consent to Establish (CTE)?

Consent to Establish (CTE) is mandatory before setting up any industrial plant, project, or infrastructure activity. It is obtained prior to construction or installation of machinery. The purpose of CTE is to ensure that the proposed business activities will not negatively impact the environment and that proper pollution control measures are planned from the beginning.

To obtain CTE from HSPCB, applicants must submit:

  • Effluent Treatment Plant (ETP) / Sewage Treatment Plant (STP) details

  • Hazardous waste management plan (if applicable)

Industries are categorized into Red, Orange, Green, and White categories based on their pollution potential. The level of scrutiny and compliance requirements depend on the category assigned.

What is Consent to Operate (CTO)?

Once the unit is constructed and pollution control systems are installed, businesses must apply for Consent to Operate (CTO). This approval allows the company to commence commercial production or operations. HSPCB verifies that all pollution control measures promised during the CTE stage are properly implemented.

CTO requires submission of:

  • CTE approval copy

  • Installation details of pollution control equipment

  • Compliance report

  • Laboratory analysis reports (if required)

  • Consent fee payment

CTO is granted for a specific validity period and must be renewed periodically.
