The Nigerian President does not have the direct power to suspend an elected Governor. According to the Nigerian Constitution, the President's executive powers are vested in him to maintain the provisions of the constitution, acts of the National Assembly, and items on which the National Assembly has power to make law.
The Constitution also provides for the separation of powers and checks and balances among the three branches of government. This means that the President cannot unilaterally suspend or remove a Governor, as that would be an overreach of his executive powers.
In fact, the Constitution stipulates that a Governor can only be removed through impeachment by the State House of Assembly or through a referendum by the people of the state .
Additionally, the Nigerian legal system emphasizes the independence and autonomy of elected officials, including Governors. The courts have consistently held that elected officials can only be removed through constitutional means, and not by arbitrary executive action.
Talking about section 305 of the 1999 constitution which talk about declaration of state of emergency by the president.
Here are the key provisions.
1. Declaration of state of emergency: The President can declare a state of emergency in the Federation or any part thereof if there is a clear and present danger of breakdown of public order and public safety.
2. Conditions for declaration: The President must be satisfied that the situation is beyond the control of the law enforcement agencies and that the declaration is necessary to restore peace and order.
3. Approval by the National Assembly: The declaration of a state of emergency "must" be approved by a two-thirds majority of both the Senate and the House of Representatives.
